Naming rights – resolving disputes about similar business names

ASIC has recently published "Disputes about similar company names" (INFO-199) providing an overview of the options available to business owners when another company registers a name that is similar.

While legislative provisions exist to stop companies from registering identical names, there are no such restrictions on the registration of names that sound alike. If a company finds itself in a situation where a competitor registers a similar name, issues of customer confusion and loss of reputation may arise.

A company name registered with ASIC does not provide the same protection as a registered trademark. If you want to protect your commercial interest ensure you have the right legal advice.
